TERMS, CONDITIONS & CANCELLATION POLICY

CANCELING YOUR RESERVATION

Cancellations must be communicated by email to booking@feastonhistory.com

If you choose to cancel your reservations for the Arthur Avenue Shopping & Tasting Tour more than one 48 hours prior to the scheduled tour date and time, the Company will refund your purchase in full.

 

Private Group Tours

If you choose to cancel your reservations for a Private Group Tour more than one (1) week prior to the scheduled tour date and time, the Company will refund 80% of your purchase price.

Within seven (7) days of the date and time of any booked Arthur Avenue Shopping & Tasting Tour or Private Group Tour, NO cancellations will be accepted, and NO refund will be paid.


 

TERMS & CONDITIONS

Thank you for using ARTHURAVENUEFOODTOURS.COM (the “Site”).

The terms ‘Company’, "we", "us", "our" and refer Feast on History, LLC, a New York incorporated company. The term "you" refers to the customer visiting the Site. All use of the Site and bookings for Arthur Avenue Food Tours are subject to the terms and conditions set out below. By accessing the Site or using our services, you agree to be bound by this Agreement in accordance with the laws of the State of New York. To the extent you book any tours or other services on this Site, you agree that these terms and conditions shall apply to all such transactions. Please read the Agreement carefully.

 

DISCLAIMER

All content, services, and prices provided to you through the Site are provided on an “as is” basis. The Company does not warrant anything of any kind, express or implied. We are not responsible for any failures caused by server errors, failed internet connections, any computer or other technical defect, whether human or technical in nature.

To the maximum extent permitted by applicable law and in addition to all other limitations and disclaimers in this Agreement, we disclaim any liability or loss in connection with the products sold and services provided. Users are to use our services at their own risk and discretion.

 

USE OF OUR SERVICES

As a condition of your use of our services, you warrant that:

You are at least eighteen years old and possess the legal authority to enter into a binding contract.

You will only use the Site to make legitimate reservations for you or for another person for whom you are legally authorized to act and will inform such person about the terms and conditions that apply to the reservations you have made on their behalf.

 

BOOKING TOURS

Tour reservations may be made online at https://arthuravenuefoodtours.com/. Payment may only be made with a valid credit card or PayPal account. Your reservation constitutes a purchase for the tour requested. Your credit card or PayPal account will be charged when you make the reservation. The charge on your account statement will show payment to ARTHUR AVENUE FOOD TOURS.

 

WEATHER

The Company is not responsible for weather conditions and tours proceed whatever those conditions are on the date and time of a tour. No ticket may be cancelled or amended by you at any time on the basis of weather conditions.

 

E-COMMERCE

To serve you most efficiently, credit card transactions and order fulfillment may be handled by a third-party processing agent or bank. The Company is not responsible for the success of or security of transactions undertaken or processed by third parties. If you are concerned about online security and payment by credit card, you may call us and place your order by phone.

 

ACCESSING THE SITE

The Company provides you a limited, temporary and non-exclusive license to use the resources of the Site and reserves the right to withdraw or amend the services offered without notice, for any reason. We are not liable if the Site is unavailable. We aim to update the Site regularly, and may change content at any time. If the need arises, we may suspend access to the Site, or close it indefinitely. Any of the material may be out of date at any given time, and we are under no obligation to update any material on the Site.

 

INTELLECTUAL PROPERTY RIGHTS

The Company owns all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print a copy of any page(s) from the Site for your personal reference. If you print, copy or download any part of the Site in breach of our intellectual property rights, your right to use the Site will cease immediately and you must return or destroy any copies of the materials you have in your possession.

 

VIRUSES

The Company is not liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

 

PARTICIPANTS OBLIGATIONS AND RESPONSIBILITIES

You represent that you are in reasonably good health and that you are not susceptible to injury or disability while performing the activities of the tour. Your participation in your tour is at your own risk. Before your tour commences. you must inform us in writing of any medical condition that requires attention or medication.

You comprehend and accept all risks associated with your participation in the tours including, without limitation, exposure to unfavorable weather conditions, food sickness, injuries and death.

During your tour, your guide may take photographs and video of you (as part of a group) and these, your likeness and your name may be used in our advertising and marketing material without obtaining any further consent or payment to you in connection with such photographs and/or other images.

When you book with us, you accept responsibility for any damage or loss you cause and agree to pay for any resulting damages immediately.

 

LIABILITY

The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, the Company and third parties connected to it hereby expressly exclude:

All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site and our services, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, or for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

Notwithstanding anything to the contrary herein, in no event shall The Company’s aggregate liability arising out of or with respect to this agreement exceed the total amount paid by you under, or in connection with this agreement, for the booking that you made that gave rise to the claim.

This provision does not affect the Company’s liability for death or personal injury arising from its gross negligence.

 

INDEMNIFICATION

You shall indemnify and hold harmless the Company, its affiliates, suppliers and any of its managers, employees, advisors, investors, and agents from and against any claims, causes of action, losses, damages, fines, penalties or other costs or expenses of any nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of i) you violating our terms and conditions; ii) you violating the law, or iii) your use of our services.

 

INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE
